Aid for Land and Property Development

The Scottish Property Support Scheme (X 155/2008) allows the Enterprise Networks and Local Authorities to support the development of new or existing premises and buildings for commercial purposes by the private sector, where market failure exists. For example, where the cost of development exceeds the end market value, or where risk-aversion prevents developers from investing in a project.

Both speculative and bespoke developments are potentially eligible for support under the scheme. Aid can be given in various forms, including grants, subsidised loans, development financing aid and development services. Aid given must be toward specific eligible costs and must be the minimum necessary for the project to proceed, subject to aid intensity levels.

Powers to offer funding are under the Enterprise and New Towns (Scotland) Act 1990, as amended 1 April 2001, by Scottish Statutory Instrument 2001, No 126 and the Local Government in Scotland Act 2003, section 20 and Articles 13,15 and 26 of the EC General Block Exemption Regulation (EC) No 800/2008.

The Support for Land Remediation Scheme (N 221 2006) is a UK-wide scheme which complements the Property Support Scheme, and allows the Enterprise Networks and Local Authorities to support the remediation of privately owned land to make it suitable for any use.

Land that is contaminated, brownfield or derelict is potentially eligible for support under the scheme. Aid can be given as a grant, up to 100% of all costs of remediation work minus the increase in the value of the land.

Polluted industrial sites may qualify for a bonus of 15%. However, where the polluter is known they must pay; no public support can be given for the land's rehabilitation.

The Partnership Support for Regeneration Scheme
(N 293 2006) is a UK-wide scheme designed to increase the supply of affordable housing. In Scotland, it allows the Scottish Government and Local Authorities to provide grant aid to developers of owner-occupied and rental accommodation in areas where such accommodation has real social or regeneration benefits.

Aid awarded must be the minimum necessary to allow the project to proceed, not exceeding the gap between the eligible costs of development and the sale value of the completed accommodation.
